Terms of Service

These terms govern your use of the Powell Electronic Inc. website, our consulting services, and the Pluvio Grow products and service.
1. Who we are

“We”, “us” and “our” mean Powell Electronic Inc. “You” means the person or organisation using our website, services or products.
2. What these terms cover
- This website, powellelectronic.ca.
- Electronic design consulting engagements, except where a signed contract says otherwise — in which case that contract governs.
- Pluvio Grow hardware, the pluviogrow.com website, and the Pluvio Grow cloud service at app.pluviogrow.com.
By using any of the above you agree to these terms. If you do not agree, please do not use them.
3. Using the website
You may browse and use this site for lawful purposes. You may not attempt to gain unauthorised access to it, interfere with its operation, or use it to send unsolicited messages. Content on the site is provided for information only and may change without notice.
4. Hardware
Pluvio Grow devices are supplied with the manufacturer's stated specification. Consumables, plants, growing media and the environment a device is installed in are outside our control.
A Pluvio Grow device is an aid to watering, not a guarantee of plant health. Devices can be interrupted by power loss, network loss, an empty reservoir, a blocked line, mechanical wear or user configuration. Do not rely on one where the loss of a plant would be unacceptable to you.
5. The Pluvio Grow service
Accounts
Access to the Pluvio Grow portal uses a sign-in link sent to your email address, so control of that mailbox is control of the account. Keep it secure and tell us promptly if you believe it has been compromised.
Availability
We aim to keep the service running continuously but do not promise uninterrupted availability. Maintenance, upstream provider outages and faults happen. Devices continue to operate on their stored schedule when the cloud service is unreachable.
Your data
Watering history, sensor readings and configuration are retained so the service can show you trends over time. How we handle personal information is set out in our Privacy Policy.
Acceptable use
Do not attempt to access devices or data belonging to others, probe or disrupt the service, or use it in a way that breaks the law.
6. SMS and text messaging
Pluvio Grow Alerts sends operational notifications about devices on your own account — for example a unit that has stopped reporting, a device fault, or a backup or system warning for account administrators.
- These are account notifications, not marketing. We do not send promotional text messages.
- Consent. You opt in by adding and confirming your mobile number in the Pluvio Grow portal. We do not add numbers on your behalf, and consent is never a condition of buying anything.
- Message frequency varies and depends on your devices and the alert settings you choose.
- Message and data rates may apply. Your mobile carrier's charges are between you and your carrier.
- To stop: reply STOP to any message, or remove your number in the portal. You will receive one confirmation and no further messages.
- For help: reply HELP, or email hello@pluviogrow.com.
- Carriers are not liable for delayed or undelivered messages.
- We do not sell, rent or share your mobile number or your SMS consent with third parties for their marketing. See the Privacy Policy.
7. Consulting services
Consulting work is quoted and scoped individually. Where a signed statement of work, proposal or agreement exists, its terms take precedence over these where they conflict. Deliverables, intellectual property ownership, confidentiality and payment terms are set out in that agreement.
8. Intellectual property
The Powell Electronic and Pluvio names and logos, the website, the Pluvio Grow firmware and the Pluvio Grow service are our property or used under licence. Buying a device does not transfer any rights in the software or brand. Patent pending.
9. Disclaimers and limitation of liability
Except where the law does not allow it to be excluded, the website, products and service are provided “as is” without warranties of any kind. To the maximum extent permitted by law, our total liability arising out of or relating to these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim, and we are not liable for indirect or consequential loss, including loss of plants, crops or profits.
Nothing here limits liability that cannot lawfully be limited, including under applicable consumer protection legislation.
10. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply in it. The courts of British Columbia have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court.
11. Changes
We may update these terms. The “last updated” date above changes when we do. Continued use after a change means you accept the revised terms.
